Canada offers many pathways to immigration including study permits with a view to eventually immigrating, business immigration programs, skilled workers through Express Entry, Family Class Sponsorships, among others.

A common thread that runs through all these programs is the potential for mistakes that lead to refusal.

The most common mistakes include:

1. Misrepresentation – Sometimes the desire to succeed pushes an applicant to overstate or outright misrepresent certain aspects of the application such as employment history, travel history, or relatives in Canada. It is never a good idea to overstate or misrepresent the facts. Not only will your application be refused, but you could be barred from re-applying for up to five years.

2. Settlement funds – All applicants must show that they are financially able to support themselves and their dependents (if applicable) for their first six months in Canada. Failure to properly documents transferrable funds that satisfy the minimum requirement will lead to refusal of the application.

3. Non-correlated information – Applicants are required to clearly document their employment history, residential history, and international travels. If there is misalignment between any of these categories, it can lead to refusal of the application.

3. Security and Medical Checks – Applications are sometimes refused on a security or medical basis.

What is the minimum required CRS score required for Express Entry to Canada?

The Express Entry system draws from a pool of candidates that may be eligible to immigrate to Canada, and to be chosen from the pool and receive an Invitation to Apply (ITA) an applicant must have an elevated CRS score.

The CRS is a points driven system whereby points accumulate based on an applicant’s profile allowing the applicant to be ranked.  The following is a list of the maximum points per factor that can be applied to a profile:

Minimum points to qualify for an ITA

The minimum number of points required to qualify (but NOT guaranteed) for an ITA varies and changes depending on the number of applicants and the number of available ITAs offered by the Government.

As of August 2020, the minimum CRS is thought to be between 460 and 470 but again keep in mind that this will vary and is open to interpretation.  Obviously the higher an applicant’s CRS score, the better chance an the applicant will have to receive an ITA.

Canadian Entrepreneur’s VISA Eligibility

IN order for an entrepreneur to qualify for the Canadian Entrepreneur VISA program, the following conditions must be met:

  • The entrepreneur’s business must be funded by a designated investor organization
  • Meet language requirements:  Speaking, Reading, Listening and Writing
  • Meet ownership requirements:  10% voting rights in the business as well as ensure that the applicant and designated organization(s)  jointly hold GREATER than 50% of the voting rights in the entrepreneur’s business

Covid-19 Effect on Canadian Immigration

As of July 6, 2020, the Canadian government has announced the following in relation to the Covid-19 restrictions and their effect on Canadian immigration:

1. For any person arriving in Canada:

When you arrive in Canada, we’ll assess your health before you leave the port of entry. You must have a plan to quarantine for 14 days when you arrive in Canada. This is mandatory, even if you have no symptoms.

If you don’t have a plan, you shouldn’t travel to Canada.

2. International Students:

Any student who has a valid study permit may enter Canada to attend their school.

You will need to pass a health test administered by the airline.

You will need to have a quarantine plan for the first two weeks immediately after your arrival.

Your working hours (20 hours per week) will not be effected after the quarantine period.

3. Holders of Permanent Residence Visas

You may arrange to land and activate your PR provided you have a clear quarantine plan for 14 days when you arrive in Canada.
